Terms of Use of TuningSoul

The TuningSoul application is published by: Ciral Studio, France. For any request, you may use the contact form.

TuningSoul is a symbolic guidance mobile application built around a personal 28-day cycle.

The application provides a daily reading based on a set of symbolic correspondences, including the current cycle, the birth chart, colors, stones, minerals, sunlight and personal writing.

TuningSoul is designed as a tool for symbolic reading, recentring and personal practice.

TuningSoul is not a medical tool, a therapeutic device, or a prediction application.

The application:

• does not establish any diagnosis;
• does not replace a healthcare professional;
• does not promise any future event;
• does not constitute a fortune-telling, divination, or good-fortune reading service.

The content offered in the application is symbolic, personal and non-diagnostic in nature.

The use of certain TuningSoul features may require the creation of an account.

The user agrees to provide accurate, sincere and up-to-date information when creating their account and using the application.

The user is responsible for maintaining the confidentiality of their login credentials and for any use made of their account.

The application is intended for personal, private and non-commercial use.

In particular, it is prohibited:

• to resell, rent, license or commercially exploit access to the application;
• to reproduce, copy, extract or reuse a substantial part of the application, its content or its operation without prior written authorization;
• to use the application for unlawful or fraudulent purposes, or in a way that infringes the rights of third parties;
• to attempt to gain unauthorized access to the systems, data or infrastructures related to the application.

The user may access certain features through a personal account.

From within the application, the user may:

• view their account;
• sign out;
• request deletion of their account.

In accordance with Apple’s requirements, applications that allow account creation must also allow the user to initiate deletion of that account directly within the app. Apple also states that deletion must remove the account and the associated data that is not legally required to be retained.

Certain features of the application are available through a paid subscription called: TuningSoul Premium.

The TuningSoul Premium subscription is offered in the following plans:

• monthly;
• annual.

The applicable prices are those displayed in the application and/or on the purchase page at the time of subscription.

Subscriptions offered through the App Store are auto-renewable subscriptions. They renew automatically at the end of their period, unless cancelled by the user before the renewal date, according to Apple’s terms. Apple states that auto-renewable subscriptions continue until cancelled by the user.

The management, modification or cancellation of the subscription is carried out through the user’s Apple account, according to the rules of the App Store.

The application may also offer a free trial period. The exact terms of this trial period are those displayed in the application at the time of subscription.

Payment is processed by Apple through the App Store.

Ciral Studio does not have access to the user’s full banking information.

Automatic renewal may be disabled at any time by the user in their Apple account settings, subject to Apple’s applicable terms.

If the user is a consumer subject to French law or European Union law, they may in principle benefit from a 14-day right of withdrawal for distance contracts. The EU recalls this 14-day right of withdrawal for distance purchases, and the CNIL also recalls that deletion requests must be processed as soon as possible and no later than within one month when a right to erasure applies.

However, for digital services and digital content provided before the end of this period, this right may be limited or lost under the conditions provided by law, particularly if the user requests immediate performance of the service. This issue depends on the legal classification of the service and the way it is provided.

The user is invited to check the applicable conditions at the time of subscription via the App Store and, where applicable, in the contractual information displayed before payment.

The use of TuningSoul involves the provision of certain personal information, including date of birth, time of birth, place of birth and account-related data.

This data is used to provide the application’s features, personalize the symbolic reading offered and enable the normal operation of the service.

The terms under which this data is processed are detailed in TuningSoul’s Privacy Policy.

The journal integrated into TuningSoul is designed as a private space.

Its content is encrypted and is not accessible in plain text by the publisher in the normal operation of the service.

In practice, only encrypted content is stored on the server side. This means that only the user can read their journal in plain text.

Ciral Studio does not use journal content for advertising, commercial or profiling purposes.

The user may request deletion of their account directly from within the application.

Account data and associated content are deleted from the active database as soon as possible after the request, except where temporary retention is necessary:

• to comply with a legal obligation;
• to handle a dispute;
• to ensure the technical integrity of the service;
• or for the temporary management of technical backups.

Technical backups may be retained temporarily before complete purging, for a maximum period of 90 days.

Technical logs strictly necessary for security, prevention of unauthorized access and incident diagnosis may be retained for a maximum period of 6 months. The CNIL recalls that data must not be retained indefinitely and that a duration appropriate to the purpose must be defined. It also recommends, for certain security logs, a rolling retention period of approximately six months to one year.

All elements composing TuningSoul, including:

• the TuningSoul name,
• texts,
• visual identity,
• the structure of the application,
• original content,
• graphic, audio, editorial and software elements,

are protected by intellectual property law.

Unless prior written authorization is granted by Ciral Studio, any reproduction, adaptation, distribution, extraction or exploitation, in whole or in part, is prohibited.

Certain features, content, screens or access methods may evolve, be modified, suspended or removed in order to:

• improve the application;
• adapt it to technical, legal or editorial constraints;
• or develop the proposed experience.

Ciral Studio does not guarantee that the application will remain identical in every respect over time.

Ciral Studio makes reasonable efforts to ensure access to the application under normal conditions.

However, access to all or part of the application may be suspended, limited or interrupted, temporarily or permanently, in particular for reasons of:

• maintenance;
• updates;
• security;
• technical constraints;
• or force majeure.

Ciral Studio makes reasonable efforts to provide an application that is carefully designed, stable and consistent with its purpose.

However, the publisher cannot be held liable for:

• a temporary interruption of the service;
• a technical malfunction beyond its control;
• the user’s use of the symbolic content offered;
• personal, professional, financial, medical or relational decisions made by the user based on the content of the application.

The user remains solely responsible for their use of the application and for the interpretation they give to the content offered.

These Terms of Use are governed by French law.

In the event of a dispute, and subject to mandatory consumer protection rules, the French courts shall have jurisdiction.

These Terms may be modified at any time in order to reflect changes to the application, its features, the legal framework or the operating methods of the service.

The applicable version is the one accessible in the application on the date of consultation or use.
